This Complementary Law, known as the General Law on State Environmental Licensing in the State of Espírito Santo, sets out general rules for environmental licensing, regulates its application and establishes guidelines for the respective procedure. Environmental licensing will follow a specific procedure to be detailed in a Decree, to be issued by the Governor of the State of Espírito Santo, and will comply with the provisions of the competent federal legislation, as well as the principles of proportionality, due process, compatibility of the free exercise of economic activity with environmental protection, procedural economy, good faith of the private party towards the public authorities, conciliation, adjustment of conduct and legal certainty, and in particular, Federal Law No. 13.874 of 20 September 2019.
