This Act outlines Taiwan's comprehensive legal framework for the conservation of marine ecosystems, biodiversity, and sustainable use of marine resources. It is enacted to protect the marine ecological environment, conserve marine biodiversity, reasonably utilize marine biological resources, coordinate and promote the planning and implementation of marine protected areas, and promote marine conservation education. The Act establishes a framework for designating marine protected areas (MPAs) and outlines provisions for activities within these zones. The Act specifies that certain activities, such as aquaculture, harvesting marine life, excavation, dredging, and construction, are prohibited in the buffer zone of a marine sanctuary unless permitted by the central competent authority. In the sustainable-use zone, similar restrictions apply, emphasizing the need for permits for specific activities. The central competent authority is responsible for setting regulations regarding application procedures, license conditions, and revocation processes. The Act also mandates the establishment of a review committee to oversee the designation and management of MPAs, ensuring that representatives from indigenous and fishermen groups are included. In order to conserve marine life, the Act includes conservation measures for: Restrictions on fishing, aquaculture, and maritime construction to prevent overexploitation; Surveys and restoration projects for marine species, including artificial habitats, breeding, and reintroductions; Education and training to promote marine conservation awareness and develop expertise in biodiversity protection; Integrating indigenous peoples and fishermen’s groups into decision-making processes to honor cultural practices and traditional knowledge. In addition, the Act makes provisions, inter alia, for: international collaboration, public participation, reporting violations, compensation, offences and penalties.
