These Regulations apply to seed produced in Wales under a temporary experiment designed to explore alternative certification requirements for CMS wheat hybrids (as defined in regulation 2). These hybrids fall within the basic or certified seed categories as outlined in regulation 5 of the Seed Marketing (Wales) Regulations 2012 (“the 2012 Regulations”). The aim of the experiment is to identify certification requirements that are more suitable than those currently specified in the 2012 Regulations. The experiment will last for 7 years, beginning on 7 October 2024. Licences issued under regulation 3(3) of these Regulations exempt participants from complying with certain provisions of the 2012 Regulations, which currently hinder the certification of CMS wheat hybrids due to conditions they cannot meet. Regulations 3 to 6 cover the purpose of the temporary experiment, the licensing process, and the effects of granting a licence. Regulations 7 and 8 allow the Welsh Ministers to vary, suspend, or revoke a licence in certain situations. Regulations 9 and 10 outline the reporting and recording requirements for participants. Regulation 11 explains the process for applying for CMS hybrid seed certification under these Regulations, which is done under the 2012 Regulations, as modified by the Schedule to these Regulations. Paragraph 7 of the Schedule modifies appeal rights under the 2012 Regulations to include decisions regarding the refusal of a licence to participate in the experiment, changes to licence conditions, and decisions to suspend or revoke licences.
