Water Resources Management (Water Abstraction, Use and Discharge) Regulations, 2010 (G.N. No. 190 of 2010).

These Regulations, made by the Minister for Water under various sections of the Water Resource Management Act 2009, make provision with respect to various licences to be issued under the Act. The Regulations concern, among other things, applications for water use permits (section 75 of the Act) and discharge permits. Applications may be referred by a Basin Water Officer to a Board established under section 20(1), section 22(1) or any board established under 29(2) of the Act. A Board may hold meetings for purpose of granting a licence. Any person having lawful access to any watercourse may abstract and use the same for domestic purposes without a Water Use Permit issued under this Act, provided that no construction of any works shall be undertaken (reg. 20). Also, any legal occupier of land may construct a shallow hand dug well and use the water for domestic purposes without a Permit issued under the Act provided that the well does not exceed a depth of fifteen metres. The Regulations also deal with appeal against decisions taken under these Regulations. (completed by one Schedule containing forms).
