These Regulations, consisting of 18 sections and one Schedule, apply to all water resources in Mainland Tanzania and establish a comprehensive classification system. This system defines the extent of water use, reserve requirements, resource quality objectives, and the permitted type of use for each water resource. It also organizes water resources into homogeneous groups based on factors such as location, type, geographical area, geomorphology, use, and other relevant characteristics, covering major water bodies including rivers, lakes, estuaries, aquifers, dams, and wetlands. The classification is structured into three hierarchical levels. Level I is based on location and geographical area; Level II categorizes water resources by type - such as rivers, lakes, dams, estuaries, and aquifers - and Level III further classifies them according to their nature, size, water use, or hydrological regime. The details of these hierarchical levels are provided in the Schedule to the Regulations. The procedures for determining water quality objectives involve applying these hierarchical levels and assessing each class within the homogeneous groups to ensure appropriate standards for protection, use, and management of each water resource. In Part III, each category is outlined in detail, divided into different classes. Under the General Provisions is established that the same classification rules used for rivers, lakes, estuaries, and aquifers may also be applied to dams, wetlands, or any other unclassified water resources, provided they are part of the same hydrological system. They also set out the procedure for determining water reserves and management priorities. This process involves collecting data on hydrology, hydrogeology, biological conditions, geomorphology, land use and land cover, socio-economic factors, and water quality. It further requires assessing water needs for domestic use, ecological sustainability, and socio-economic activities, depending on availability. In addition, it includes identifying threats and opportunities related to water quality, as well as defining and prioritizing management actions in consultation with relevant stakeholders.
