Constitutional Law No. 28 “On Government”.

This Constitutional Law establishes the legal framework governing the Government as the central executive authority. It defines the Government as a collegial body that leads the system of public administration, ensuring the implementation of laws and coordinated functioning of state bodies. Its activities are based on the Constitution, national legislation, presidential decrees, and recognized international legal acts, and guided by principles such as the rule of law, separation of powers, transparency, and protection of human rights. The Law regulates the structure, composition, and formation of the Government, which is headed by the President and includes the Prime Minister, deputies, ministers, and heads of state committees. Members are appointed and dismissed by the President with parliamentary approval and must hold only Tajik citizenship, take an oath, and comply with strict incompatibility and anti-corruption rules. The Government’s mandate is linked to the term of the President, and provisions are provided for resignation, dismissal, and accountability. It also outlines internal organization, including meetings, decision-making procedures, and roles of key officials such as the Prime Minister and deputies. The Law extensively details the powers of the Government across all policy areas. These include directing ministries, shaping and implementing economic, financial, and social policies, managing state property and budget, supporting science, education, and culture, ensuring environmental protection, and maintaining public order, security, and defense. It also governs foreign relations, legislative initiative, and cooperation with parliament, courts, local authorities, and public organizations. Additional provisions cover the issuance of binding acts, organization of administrative bodies, financing, and material support, ensuring the Government’s effective operation within the broader constitutional system of the country.
