This Act concerns emergency management operations and therefore binds the Government of the Northwest Territories and public agencies. The Act defines the following relevant terms: community; declaration of a state of emergency; emergency, as a current or imminent event that requires prompt coordination of action or special regulation of persons or property in order to protect the safety, health or welfare of people or to limit or prevent damage to property or the environment; emergency management; emergency operations; local authority. The Act covers the following matters: powers of the Minister, including: reviewing and approval of territorial and local emergency plans and programmes, establishing committees to advise or assist in the administration of this Act; definition of hazardous condition and preparation plans to remedy a hazardous condition; agreements respecting emergency management; establishment of the Emergency Management Organisation, appointment of its members and definition of its functions including: preparing policies and programmes concerning emergency management, providing education and training related to emergency management, promoting a common approach to emergency management, including the adoption of standards and best practice, procuring food, fuel, water, medicine, equipment, goods, materials and services of any nature or kind for the purposes of this Act, providing advice and assistance to local authorities in the development, implementation and maintenance of emergency programmes and plan, authorising and requiring surveys or studies to identify and record actual or potential hazards, risks and vulnerabilities. Further matters covered by this Act include: duties and powers of the Head of the Emergency Management Organisation; establishment of territorial planning committee and related powers and duties; content of territorial emergency plans: description of the emergency management system of the Northwest Territories, specification of roles and responsibilities of departments of the Government of the Northwest Territories and public agencies in responding to emergencies, definition of procedures for the coordination of responses to emergencies by departments of the Government of the Northwest Territories and public agencies; powers and duties of local authorities; content of local emergency plans; declaration of state of emergency and emergency response; powers of the Minister during a declared state of emergency; compensation in case of damage or destruction to personal property in the event of actions authorised by the Minister to prevent, combat or alleviate the effects of an emergency; declaration of state of local emergency; powers of local authorities; dispute resolution mechanism concerning the amount of compensation; offences, penalties and fines.
