Oder No. 609 on geographical indications and quality schemes for wine, spirit drinks and agricultural products, including foodstuffs.

This Order establishes Denmark’s procedural and enforcement rules for geographical indications and quality schemes for wine, spirit drinks and agricultural products, including foodstuffs. It requires applications for registration of protected designations of origin, protected geographical indications, geographical indications for spirit drinks, and guaranteed traditional specialities, as well as applications to amend product specifications, to be submitted to the Danish Veterinary and Food Administration. It also provides for national publication of applications, a one-month opposition period for persons or legal entities with a legitimate interest established or resident in Denmark, and procedures for Denmark-based objections to applications published by the European Commission. The Order further sets penalties for breaches of EU rules on geographical indications, guaranteed traditional specialities, traditional terms, optional quality terms and spirit-drink labelling and presentation, including fines, possible imprisonment of up to two years for serious intentional or grossly negligent breaches causing or risking harm to health or producing economic gain, and criminal liability for legal persons.
