Decree No. 58.804 providing for the environmental regularisation of rural properties and establishes the Rio Grande do Sul Environmental Regularisation Programme (PRA/RS).

This Decree establishes the Environmental Regularisation Programme of the State of Rio Grande do Sul (PRA/RS) and provides a comprehensive framework for the environmental regularisation of rural properties. Its principal objective is to ensure compliance with Brazil’s Forest Code by addressing environmental liabilities related to Permanent Preservation Areas (APPs) and Legal Reserves (RLs). The decree creates procedures through which rural landowners and possessors can restore, regenerate, maintain or compensate environmentally protected areas, using instruments such as the Rural Environmental Registry (CAR), the Project for the Restoration of Degraded and Altered Areas (PRADA), Commitment Agreements (TCs), and Environmental Reserve Quotas (CRAs). The programme seeks to reconcile agricultural land use with environmental conservation by promoting the recovery of native vegetation and the protection of ecologically important areas. The decree also establishes detailed procedures for programme participation, monitoring and enforcement. It sets out obligations for rural property owners to remedy environmental deficits, defines acceptable methods for restoring degraded areas, and specifies mechanisms for compensating Legal Reserve deficits. In addition, it provides legal incentives for participation, including the suspension of certain administrative sanctions relating to irregular vegetation clearing that occurred before 22 July 2008, provided that participants comply with their restoration commitments.
