The Marine Farming Planning Regulations 2026, made under the Marine Farming Planning Act 1995, establish administrative and enforcement provisions governing marine farming activities in Tasmania. The Regulations prescribe fees and charges payable for applications, leases, lease variations, marine farming development plans and related matters under the Act. They also establish procedures by which persons may apply to the Minister for the remission of fees already paid or for exemption from the payment of fees and charges before they become payable. The Regulations create an infringement notice regime by prescribing a range of offences under the Act for which infringement notices may be issued and specifying the applicable monetary penalties. In addition, they provide a special penalty calculation method for offences involving marine farming operators exceeding an assigned quantity of dissolved nitrogen under a marine farming development plan. The instrument also sets out schedules containing application fees, annual lease fees for shellfish and finfish farms, and charges for amendments and lease variations.
