Decree 21 July 2024 concerning rules for the identification of surfaces and areas suitable for the installation of renewable energy plants.

The Decree implements Article 20 of Legislative Decree No. 199 of 8 November 2021 by allocating among Italy’s regions and autonomous provinces the national target of 80 GW of additional renewable energy capacity by 2030. The measure establishes uniform principles and criteria for identifying areas suitable or unsuitable for renewable energy installations, applying the principle of technological neutrality. Regions must classify land and surfaces as suitable areas, unsuitable areas, ordinary areas, or agricultural areas where ground-mounted photovoltaic installations are prohibited. Suitable areas benefit from accelerated and simplified procedures for constructing and operating renewable energy plants and related infrastructure, while ordinary areas remain subject to standard authorisation procedures. Unsuitable areas are those whose characteristics are incompatible with specific types of renewable energy installations, particularly in view of environmental, territorial, landscape, cultural heritage, agricultural and forestry considerations. The framework seeks to accelerate renewable energy development while minimising impacts on the environment, land, cultural heritage and landscape and protecting agricultural and forest areas, air quality and water bodies. It prioritises built surfaces, industrial buildings, car parks, industrial and logistics zones, disused industrial sites, degraded or marginal areas and land that cannot reasonably be used for other purposes. Regional planning must also consider renewable resource availability, electricity demand, grid infrastructure and constraints, local authority participation and the prohibition introduced in 2024 on certain ground-mounted photovoltaic installations on agricultural land.
