This Implementing Rules and Regulations (IRR) gives effect to Republic Act No. 12074, which establishes a freshwater fish hatchery in the Municipality of Talacogon, Agusan del Sur, and provides funding for its establishment and operation. The IRR designates the Department of Agriculture, through the Bureau of Fisheries and Aquatic Resources (DA-BFAR), as the implementing agency responsible for conducting feasibility studies, preparing engineering designs, supervising construction, allocating funds, and managing initial operations. It provides for the gradual transfer of hatchery management to the Local Government Unit of Talacogon within two years through a Memorandum of Agreement, requiring the creation of plantilla positions and a dedicated trust fund for hatchery revenues and fisheries development projects. The IRR further establishes monitoring, reporting, technical assistance, and training mechanisms, and contains provisions on implementation, amendment, publication, and filing with the Office of the National Administrative Register.
