Decree-Law No. 39/2024 establishing the rules governing the entry into or departure from national ports by domestic or foreign ships or vessels.

This Decree-Law establishes the legal regime governing the entry and departure of national and foreign ships and vessels from Cape Verdean ports. The law aims to implement the standards of the International Maritime Organization’s Convention on Facilitation of International Maritime Traffic (FAL Convention), simplifying and harmonising administrative formalities related to maritime transport. It seeks to modernise port procedures, reduce bureaucracy, improve coordination among maritime, port, customs, border, health and phytosanitary authorities, and facilitate commercial maritime operations while maintaining appropriate public control and oversight. The law further introduces a framework for the electronic processing of arrival and departure procedures through the national Port Single Window system (Janela Única Portuária). It establishes standardised declaration requirements, conditions for authorisation of entry and departure, inspection procedures, and the responsibilities of the authorities involved. By promoting the digital submission and sharing of information, the legislation aims to increase efficiency, transparency and interoperability within public administration, improve the management of port activities, and ensure compliance with safety, security, customs and public health requirements applicable to maritime transport.
