This Chapter lays down rules relative to the placing on the market and use of pesticides. The Chapter requires all pesticides used and sold in American Samoa to be registered by the Environmental Protection Agency and licensed with the Department of Agriculture. The Chapter specifies labelling requirements and provides for permits for experimental use and the placing on the market of restricted use pesticides and certification of applicators of restricted use pesticides. A “restricted use” means use for a specific purpose such as forest pests control or aquatic pest control. The Chapter further provides for measures of control and enforcement.
