Consumer Protection Act (KSchG).

The Act establishes the framework for consumer rights and business obligations in commercial transactions. The Act applies to transactions involving businesses and consumers, defining what constitutes a business and a consumer. In particular, the Act focuses on regulations related to consumer transactions, rights, and protections in various contractual scenarios. The Act introduces provisions on remedies for non-performance, contractual guarantees, and manufacturers’ durability guarantees, while clarifying rules on return of goods, transfer of risk, and the non-excludability of statutory warranty rights. It also extends the grounds for injunction claims in cases of infringements of consumer information and protection obligations. The amendment implement Directive (EU) 2019/770 on contracts for the supply of digital content and digital services and Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods. The amendments strengthen consumer rights in cases of delay in the performance of contracts and the supply of digital content or services, including the right to set an additional period for performance and, in specified circumstances, to withdraw from the contract.
