These Measures are enacted according to the relevant provisions of the Law of the People's Republic of China on Administrative Penalty, aiming at regulating the hearing procedures for administrative punishments for market supervision and administration, guaranteeing the imposition of administrative punishments by the market regulatory departments according to the law, and protecting the lawful rights and interests of natural persons, legal persons and other organizations. The Measures consist of 35 Articles divided into 6 Chapters: General provisions; Application and acceptance; Hearing Organizers, Hearing Personnel and Hearing Participants; Hearing preparation; Hearing; and Supplementary Provisions. Before making one of the decisions of administrative punishments as stipulated in Article 5, the market regulatory department shall notify the party of the right to request holding of hearings. Hearings shall be organized by the legislative affairs offices of the market regulatory departments or other institutions. A hearing presider shall be designated by the person in charge of the market regulatory department.
