Complementary Law No. 152 creating the Environmental Defense and Development Fund, the State Council and the Regional Environmental Councils.

This Law aims to strengthen environmental governance in the State through the creation of integrated financial and institutional mechanisms for environmental protection and sustainable development. To this end, the Law establishes the Environmental Defense and Development Fund (FUNDEMA) and restructures the State Environmental System by creating the State Environmental Council (CONSEMA) and Regional Environmental Councils. These instruments are designed to support public policies aimed at environmental conservation, restoration of degraded areas, environmental education, scientific research, ecological monitoring, and the sustainable economic use of native flora and fauna, ensuring that financial resources from environmental fines and other revenues are directed toward priority environmental actions. The Law also aims to promote participatory, decentralized, and technically informed decision‑making in environmental management. By instituting councils with equal representation from government, the private sector, and civil society, the Law seeks to enhance transparency, resolve environmental conflicts, and guide state policies on natural‑resource protection. The Councils are vested with authority to deliberate on environmental standards, evaluate environmental impact studies, oversee climate‑related measures, and encourage sustainable development practices across economic sectors. Overall, the Law aims to integrate environmental protection with economic planning while ensuring accountability, social participation, and long‑term ecological sustainability within the state.
