Rules of Procedure Regarding Capacity Loans or Concessions and Chartering of Vessels with Temporary Transfers of Capacity (C-12-06).

The procedures establish clear rules for capacity loans, concessions, and vessel charters within the IATTC framework. Vessels operating under loaned or conceded capacity must be registered under the receiving Member or Cooperating non-Member (CPC's) flag, while ownership of the capacity remains with the lending CPC and reverts to it upon deregistration or flag change. The receiving CPC assumes full legal responsibility for ensuring the vessel’s compliance with IATTC and Agreement on the International Dolphin Conservation Program (AIDCP) regulations during the loan period. For temporary vessel charters, proper documentation and mutual notification between the chartering and charterer CPCs are required for any change of flag or capacity transfer to be recognized in the Regional Register.
