Agricultural Produce Board Enactment 1981.

This Enactment, comprising 50 sections, aims to regulate the procedures to establish boards in respect of any agricultural product or products. The Enactment provides for the composition of such boards; it also outlines the terms for appointed members and the circumstances for vacation of office. Part V focuses on the functions of the boards, which are to promote, control, formulate, and implement policies for the development and sustainability of its designated product's industry. This involves improving producer conditions, increasing production, and enhancing quality through resource management, economic production, inspection, and marketing. They also manage the Fund established for the Board and are responsible for assisting (including financial aid) to relevant bodies, cooperating with the government and others, liaising, offering technical/advisory services, protecting industry interests, gathering information, issuing licenses, and appointing necessary agents or experts to execute its functions. Under Section 25, the Governor of Sabah, on the recommendation of a Board, may impose a levy upon any product in respect of which such Board was established. As for the financial matters, in respect of every Board, there shall be established a Fund applied to cover the operational costs of the Board, including salaries and expenses for members, along with general running costs, management fees, and authorized grants or loans to the State. An authorized officer may at any reasonable time enter any premises for (a) inspecting any product, equipment, device, appliance, material, receptacle, package, conveyance, book, record, document, computerized data or other thing as he considers necessary; or (b) verifying the accuracy of records or statements or any information given to an authorized officer or to the Board.
