Law No. 178 Digital Code.

The Digital Code establishes a comprehensive legal framework for regulating relations in the digital environment, defining more than 100 key terms and setting foundational principles such as fairness, legal certainty, technological neutrality, openness, and digital sustainability. It governs the creation, processing, storage, access, and use of digital data, digital records, digital resources, digital services, and digital ecosystems. It also regulates digital identities, including personal identifiers and biometric systems, and enshrines digital rights such as access, control, portability, and participation in digital communities. The Code outlines the roles and responsibilities of stakeholders, including owners of digital records and resources, providers of digital services, operators of digital technological systems, users, and regulators. It defines mechanisms for public, private, and public private digital interactions, establishes requirements for trusted digital services (e.g., digital signatures, authentication, archives), and sets rules for automated decision making and the use of smart contracts. It also contains detailed provisions on personal data protection, including principles of lawfulness, transparency, data minimization, accuracy, storage limitation, and security, as well as special rules for sensitive data, children’s data, cross border transfers, and data subject rights (access, correction, deletion, objection, portability). Additionally, the Code regulates telecommunications, national digital infrastructure, cybersecurity, risk management, and systems of artificial intelligence, including high risk AI. It sets procedures for state oversight, accreditation, digital resilience, incident reporting, and dispute resolution. The document further governs the national digital ecosystem, government digital services, digital registries (including spectrum and numbering), and the gradual digitalization of public resources. Overall, the Code aims to create a unified, transparent, and secure legal environment supporting innovation, competition, and the protection of rights in the national digital sphere.
