This Regulation, implementing the Energy Resources Activities Act, concerns matters related to facilities that manufacture hydrogen. The Regulation defines the following relevant terms: class 1 and 2 hydrogen facility and related permits; codes and standards; emergency; emergency planning zone; hazard; hazard planning zone; hydrogen facility; hazardous product; local Indigenous nation; qualified professional; safety critical devices. The Regulation provides for: application for Class 2 hydrogen facility permit and preliminary activities, including: assessment of the likely nature, geographic area and timing of the impacts, providing notice of the likely nature, geographic area and timing of the impacts; amendment and extension of Class 2 hydrogen facility permit; application for Class 1 hydrogen facility permit and requested records; Hydrogen facility general requirements; fugitive emissions management plan; process safety management system; measures to minimise adverse effects; operation of Hydrogen Facility and pre-operation testing; determination of quantity of electricity and quantity of waste generated by the facility; emergency response plan, risk assessment and management; suspension and decommissioning of hydrogen facility; determining thermal radiation flux.
