This Law regulates the environmental compensation mechanism in the State of Maranhão for projects that generate significant environmental impacts and are subject to environmental licensing based on Environmental Impact Assessments (EIA/RIMA). It requires developers to allocate financial resources to support the creation, implementation, maintenance, and management of protected areas within the State System of Conservation Units (SEUC), especially those directly affected by a project or located within its area of influence. The Law establishes the principles, procedures, and criteria for determining the degree of environmental impact and calculating the corresponding compensation amount, ensuring that environmental damages are considered during the licensing process. The Law also creates the State Environmental Compensation Chamber (CECA) and sets out rules for the allocation, management, transparency, and oversight of compensation funds. Resources must be directed according to defined priorities, including land regularization, management plans, conservation unit protection and monitoring, environmental research, and the creation of new conservation areas. In addition, the Law establishes a methodology for calculating compensation based on the magnitude, extent, duration, and ecological significance of environmental impacts, aiming to strengthen biodiversity conservation and improve the effectiveness of protected area management in Maranhão.
