Decree-Law No. 190/91 establishing that assets held under a usufruct arrangement shall be disposed of for monetary consideration.

This Decree-Law main objective is to facilitate the transfer of agricultural assets held under the right of beneficial use (posse útil) by allowing their sale by the State, municipalities, or other public entities that own them. The decree seeks to strengthen tenure security and encourage investment in agriculture by granting holders of beneficial-use rights a preferential right to purchase the land they occupy. It also provides for the possibility of obtaining credit on preferential terms to support such acquisitions, thereby promoting greater participation of farmers in land ownership and agricultural development. A second objective of the decree is to streamline the institutional management of agrarian reform. To this end, it transfers the non-judicial functions formerly exercised by the Agrarian Reform Commissions to the services of the Ministry of Rural Development and Fisheries, with the aim of improving administrative efficiency and integrating agrarian reform activities into the regular structures of government. The decree also repeals specific provisions of the previous agrarian reform legislation as part of the ongoing modernization of the legal framework governing land tenure and rural development in Cape Verde.
