Mining Law No. 7/2026.

This Law approves a new Mining Law for Mozambique and repeals Law No. 20/2014 of 18 August. Its principal objective is to modernise the legal framework governing geological and mining activities in response to developments in the mining industry and the national economy. The law regulates the exploration, exploitation, processing, treatment and commercialisation of mineral resources, while promoting sustainable development, transparency, competitiveness, industrialisation, value addition within the country, and increased public revenues. It also seeks to protect existing rights, clearly define the rights and obligations of mining title holders, reinforce State sovereignty over mineral resources, and ensure that mineral wealth contributes effectively to the country's economic and social development. The law further aims to strengthen national participation and benefits from the mining sector by enhancing State involvement throughout the mineral value chain, establishing mechanisms for local content, domestic processing of minerals, community participation, local development funding, and the equitable sharing of benefits with affected communities. It creates the National Mining Company (ENM), transforms the National Mining Institute (INAMI) into the Mining Regulatory Authority (AREMI), introduces rules for strategic minerals, public tenders and auctions, environmental protection, local employment, transparency, and mineral traceability, while reinforcing social, environmental and governance requirements applicable to mining operations. The law substantively addresses mineral water resources, the use of water in mining operations, and the protection of water resources from mining-related impacts.
