This Decree-Law establishes the legal framework governing the operation and commercialisation of tourism accommodation establishments classified as Complementary Accommodation (Alojamento Complementar). The principal objective of the regulation is to formalise and regulate a rapidly expanding segment of the tourism sector, comprising apartments, villas and rooms offered for temporary tourist accommodation outside the traditional hotel model. The Decree aims to reduce informality, ensure fair competition, improve service quality, protect tourists’ rights, and provide clear legal, administrative and fiscal rules for operators. It also seeks to adapt the tourism sector to changing market trends, support sustainable and inclusive tourism development, and strengthen Cabo Verde’s position as a high-quality and secure tourism destination. The regulation establishes detailed requirements concerning the registration, licensing, operation, advertising, safety standards and inspection of complementary accommodation establishments. It defines the rights and obligations of both service providers and guests, introduces a simplified licensing system with electronic registration, establishes capacity limits and operating conditions for apartments, villas and rooms, and creates mechanisms for monitoring, taxation and enforcement. In addition, the Decree promotes sustainable tourism practices, safeguards the balance between tourism activities and access to housing, regulates online marketing and intermediation platforms, and introduces sanctions for non-compliance, thereby creating a comprehensive governance framework for the complementary accommodation sector throughout Cabo Verde.
